Fantastic Privacy Statement

Grokr, Inc. (the “Company,” “us,” “we”) is the name of our company, and we develop “Fantastic,” a smart music player that brings you content and information related to your music and your music tastes. The very nature of Fantastic requires that we collect a lot of information about you, and we’ve put together this privacy policy so that you can understand the information we collect, how we use that information, and how we disclose that information to others. We know privacy is important to many of our users, and we’ve developed Fantastic in a way that gives you choices with respect to how information about you is collected and used. If you don’t want to connect Fantastic with your social networking accounts, you don’t have to. Let us know if you have any questions. This policy applies to your use of Fantastic, regardless of how it’s accessed. We tried to keep it short, so please review with care. If you do not agree with this privacy policy, do not access or use Fantastic.

  1. Information Fantastic Collects

    We collect information when you register with Fantastic, and when you use or access Fantastic. For example, we collect:

    1. Search terms submitted by you, along with the date and time of those submissions.
    2. Search results and other content that you select or view through the app.
    3. Information about the music available on the same device as Fantastic, including artist name, album and songs.
    4. Your device location information. Fantastic may collect information from your device that can be used to identify its location, including data from your device’s GPS, wi-fi, accelerometer, and compass sensors. This information may be collected when Fantastic is open on your device, as well as when you are not using Fantastic.

    We collect information if you choose to connect Fantastic with one of your other online accounts, such as your Facebook, Twitter, and Spotify accounts. For example, we may collect:

    1. Your basic account information from Facebook, which consists of your name, email, gender, birthday, current city, and profile picture URL.
    2. Your other information available through Facebook, such as your interests and demographic data such as your favorite authors, musicians, sports teams, etc., and your political leanings, birthplace, and marital status, but in each case only where you permit Facebook to let us access this information.
    3. Your bio and following list, and other information we may attempt to infer from these materials.
    4. Your playlists, listening history, followed artists, and other information from your Spotify Premium account.

    If you want Fantastic to discontinue collecting additional information from your other online accounts, you can disable Fantastic’s connection.

    We also automatically receive and record information from your device when you use Fantastic. This information may include your device type and version, a unique identifier associated with your device, crash logs, and information about the duration of time Fantastic is open on your device.

  2. How Fantastic Uses and Discloses Your Information

    We use (or may choose to use) your information for the following purposes: to customize your experience when using Fantastic, including your search results and other content that we may make available to you through Fantastic, to show you information based on your devices current and past location, such as the routes you commonly take, to show you promotions, sponsored content or materials from our advertisers that you may be interested in, to fulfill your requests for products, services and information, to respond to questions and concerns that you have submitted to us, to improve Fantastic and help us to provide you with new features and services, to communicate with you, and to provide anonymous reporting for internal and external persons.

    Some of the promotions, sponsored content, or advertisements that we may show or send to you may only be shown to you because you meet certain qualifying criteria. By responding to such promotions, advertisements, or sponsored materials you may be disclosing to third parties that you meet these criteria.

    We do not rent, sell, or share information about you with other people or unaffiliated companies except to provide products or services you have requested, or when we have your permission, or under the following circumstances:

    • Service Providers. We provide certain information to service providers who work on behalf of or with us to help us provide Fantastic and communicate with you. For example, some of the servers and storage systems we may use to support Fantastic could be operated by these service providers. We require these service providers to maintain your information consistent with the agreements we enter into with them.
    • Location Information Processing. Fantastic third party service providers may collect or use location-related information, including data collected from your device’s GPS, wifi, accelerometer, and compass sensors, for the purpose of (1) processing your device’s location information and providing us with information about your device’s location such as nearby businesses, institutions, and landmarks, and (2) improving the performance of these third party services.
    • Legal Requests. We will provide information in response to subpoenas, court orders, or other legal requirements, or to establish or exercise our legal rights or defend against legal claims.
    • Protection. We provide information to third parties when we believe it may be useful to investigate, prevent, or take action regarding illegal activities, fraud, threats to the safety of any person or property, violations of the terms and conditions that govern your use of Fantastic, or as otherwise required or permitted by law.
    • Merger or Business Changes. We would transfer information about you if we or Fantastic are acquired by or merged with another company, if we reorganize ourselves into another company, or if we undergo a similar transaction in which information about you would be an asset that is assigned or transferred to a third party. In this event, we will attempt to notify you before information about you becomes subject to a different privacy policy.
    • In Aggregate. We may share aggregated, non-personally identifiable information publicly and with third parties for purposes that we deem, in our sole discretion, to be appropriate. For example, we may share demographic information about our users with prospective advertisers.
  3. Your Information and Communications

    You can see some of the information we know about you by going to Settings à About Me. You can opt out of receiving future promotional emails, but we reserve the right to continue to send you certain communications relating to Fantastic, such as service announcements and administrative messages, without offering you the opportunity to opt out of receiving them.

  4. Editing and Deleting Your Information

    You can delete your account and request that we delete your information. Even after we delete your information, some or all of your information might remain in our archived records and backups. We may also continue to retain some of your non-personally identifiable information in our systems even after we delete your personally-identifiable information.

  5. Confidentiality and Security

    We have implemented physical, technical, and managerial safeguards in an effort to protect the information we maintain about you. Despite our efforts, unauthorized persons may access your information and account. We cannot promise that your information will always be secure.

  6. Changes to this Privacy Policy

    We may update this privacy policy from time to time. We will notify you about significant changes in the way we treat information by placing a prominent notice within Fantastic, sending a notification to your device, or by sending a notice to the primary email address you’ve provided to us, so please make sure that your email address is accurate and current.

  7. Children

    We do not knowingly collect or retain personally identifiable information about persons under 13 years of age. If we learn that personally identifiable information of persons under the age of 13 years has been collected through Fantastic without verifiable parental consent, then we will take the appropriate steps to delete this information.

    If you are a parent or guardian and discover that your child under the age of 13 has obtained access to Fantastic, then you may alert us at and request that we delete that child’s personal information from our systems.

  8. Third Party Information

    Some of the services or materials included or accessible through Fantastic may be delivered or served by third-party companies that may place or recognize cookies, use web beacons (sometimes called “clear gifs”) and other technology to track certain information about your use of Fantastic. For example, you may be able to search for and view third-party websites within Fantastic. We do not control third-party companies' use of cookies or other tracking technologies, and your use and access to third party services is subject to such parties’ own policies related to the collection, use, and disclosure of information.

  9. International Users

    Users from outside the United States should be aware that they are submitting their information to servers within the United States and that they may not be entitled to protections and remedies provided under laws of their places of residence.
